Who is responsible for your data

This website is operated by Daniela Krol, an independent artist working as a sole proprietor (osek) based in Tel Aviv, Israel ("the studio", "we", "us"). The studio is the data controller for personal information collected through this site. You can reach us at futurecreatorsclub@gmail.com.

What we collect

• When you send an inquiry or acquisition request: your name, email address, phone number (if you provide it), city, country, a link to your Instagram, Facebook, LinkedIn or website, the work you are asking about, and any message you write.
• When you register for the Live Salon or a live auction: your name, email address, phone number (if you provide it), whether you prefer to be contacted on WhatsApp, and whether you want your first name and last initial shown to the room or want to bid as an anonymous paddle number.
• Bid activity during a live sale (amounts and timestamps), linked to your paddle.
• Technical information that any website receives automatically: your IP address, browser type, and access times, recorded by our hosting provider for security and to deliver the pages.
• Anonymous, aggregate usage analytics that the studio hosts itself on its own database: which pages are viewed, how long is spent on each, how far people scroll, a coarse device type (mobile / tablet / desktop), the browser window width, the browser language, the time zone, and the site or campaign that linked here. It records no name, no email, and no IP address, it stores nothing on your device (no cookies, no local storage), and it does no fingerprinting: the signals above are never combined into an identifier. Each visit is grouped by a random number that exists only in the page while it is open and is discarded when you reload or close the tab. The data is used only in aggregate and is never linked to your inquiry or registration details. The analytics does not run at all if your browser sends a Do Not Track or Global Privacy Control signal.

We do not use advertising trackers, social media pixels, cross-site tracking, or profiling of any kind, and we do not sell or share this data with anyone. It is stored in the European Union (Frankfurt) and kept for a rolling window of 180 days, then deleted. Legal basis: our legitimate interest in measuring and improving our own website, which is a light touch on your privacy given that the data is minimal, non-identifying, and stored nowhere on your device.

Why we use it, and our legal basis

• To respond to your inquiry and to arrange and complete a sale. Legal basis: performance of a contract, or steps taken at your request before entering a contract.
• To run the Live Salon and auctions, verify who is bidding, and enforce the auction rules. Legal basis: performance of a contract, and our legitimate interest in running fair sales.
• To keep records of sales and correspondence, for security, and to comply with tax and accounting law. Legal basis: legal obligation, and legitimate interest.
• To contact you on WhatsApp, or to send you occasional updates if you ask us to. Legal basis: your consent, which you can withdraw at any time.

Who we share it with

We never sell your personal information. We share it only with service providers who help us run the site, and only as needed:

We may also disclose information if required by law, to enforce our terms, or to protect the rights, property, or safety of the studio or others.

International transfers

Some of these providers are outside Israel and the European Economic Area. Where that is the case, the transfer is covered by the European Commission's Standard Contractual Clauses or an equivalent safeguard, or by the provider's certification under an approved framework.

How long we keep it

Records connected to a sale, an offer, or a payment are kept for as long as the relationship is active and then for the period required by Israeli tax and commercial law, currently seven years. Inquiries and messages that do not lead to a sale are kept only as long as needed to deal with them and are deleted sooner if you ask. Registration details for a live sale you did not win are deleted once the event and any follow-up are complete.

Anonymous analytics records are kept for a limited rolling window (currently 180 days) and then deleted automatically.

Your rights

You can ask us to give you a copy of the personal information we hold about you, correct it, delete it, restrict how we use it, or object to a particular use. Where we rely on your consent, you can withdraw it at any time. To make a request, email futurecreatorsclub@gmail.com. We will respond within the time the law allows.

If you are not satisfied with how we have handled your information, you can complain to the Israeli Privacy Protection Authority. If you are in the European Economic Area or the United Kingdom, you can complain to your local data protection authority.

Children

This site is intended for adults. It is not directed at children, and we do not knowingly collect information from anyone under 18.

Security

Connections to this site are encrypted with HTTPS. Database access is protected by row level security and limited to the studio. No method of transmission or storage is completely secure, but we take reasonable steps to protect your information.

Changes to this policy

If we change this policy we will update the date at the top of this page. Significant changes affecting an active inquiry or sale will be communicated to you directly where practical.

Cookies and Local Storage

What this site stores in your browser, and why there is no consent pop-up.

This site sets no cookies of its own, uses no advertising or third-party tracking, and stores nothing on your device for analytics — no cookies, no local storage, no session storage. The studio's visit analytics keeps only aggregate, non-identifying data on its own server (no name, no email, no IP address, no fingerprinting), and it does not run when your browser sends a Do Not Track or Global Privacy Control signal. Because nothing is stored on or read from your device and no personal data is retained, a cookie consent pop-up is not required. The only browser storage this site uses is the strictly necessary items below, so that a live sale works while you are in it:

Your browser also contacts Google Fonts and Fontshare to load the site's typefaces, and our host to load the pages. These providers receive your IP address as a normal part of serving the site. See the Privacy Policy above for details.

Ownership and copyright

All artwork, images, text, layout, and design on this site are the property of Daniela Krol and are protected by copyright. Buying a work, whether by inquiry or at auction, transfers ownership of that individual piece as described at the point of sale. It does not transfer copyright or any reproduction rights. The artist retains all rights to reproduce, exhibit, and license images of the work.

You may view and share links to the site for personal, non-commercial purposes. You may not copy, download in bulk, scrape, republish, or use any content from this site to train machine learning or generative AI systems, without the artist's written permission.

Acceptable use

Do not attempt to disrupt the site, gain unauthorised access to the auction rooms or admin areas, submit false information, or use the site in a way that breaks the law.

No warranty

The site is provided as it is. We work to keep it accurate and available but do not guarantee that it will be uninterrupted or error free. Colours shown on a screen are an approximation and may differ from the physical work.

Links to other sites

Links to third-party sites, such as Instagram, are provided for convenience. We are not responsible for their content or their privacy practices.

Terms of Sale

For works acquired by inquiry and for prints bought in the Shop. Auction purchases are also covered by the section below.

How a sale is formed

Prices shown on the site are an indication. Submitting an acquisition request is not a binding offer and does not reserve a work. A sale is formed only when the studio confirms availability and price to you in writing and payment has been received in full.

Price, currency, and payment

Prices are in Israeli new shekels (₪) unless we agree otherwise in writing. Payment is due in full before a work is dispatched, by the method set out on the studio's invoice. The buyer is responsible for any bank or transfer fees.

Taxes, shipping, and customs

Unless stated otherwise in the invoice, the price does not include shipping, insurance in transit, or any import duties, VAT, or customs charges due in the destination country. Those are the buyer's responsibility. Once a work is acquired, the studio will contact you to arrange packing and shipping and to confirm the cost.

Delivery (prints bought through the Shop)

You choose how your print is delivered at checkout:

• Courier in Tel Aviv, to the address you provide.
• Self pickup from the studio, Yedidya Frenkel 35, Tel Aviv — available Sunday through Thursday, by appointment arranged with you on WhatsApp.

We aim to have your order ready within 10 business days of the weekly order window closing, and in any event within 21 business days. This site is not responsible for a delay in delivery caused by a third-party courier, where that delay results from an event beyond our control (including force majeure, strikes, or a shutdown) or from your unavailability to coordinate the delivery.

Title and risk

Ownership of a work passes to the buyer when payment has cleared in full. Risk passes when the work is handed to the carrier.

The work you receive — original works (acquired by inquiry)

Each original work is a unique piece or part of a small numbered edition, as described at the point of sale. It is supplied at its stated size and finish, signed, with a Certificate of Authenticity. Each physical work is individually finished by the artist. Minor variations may occur during production and finishing.

The print you receive — prints (Shop orders)

Each print is supplied at the size and finish you chose at checkout. Prints are produced to order and are not signed and do not include a Certificate of Authenticity — these are reserved for original works acquired by inquiry. Minor variations may occur during production and finishing.

Cancellation and returns — original works (acquired by inquiry)

All sales are final once payment has been confirmed. Because each work is made or finished to order as a one of one or a small edition, it is exempt from distance-selling cancellation rights that might otherwise apply. Auction purchases are final and are never subject to a cooling-off period.

This does not affect your rights under the Israeli Consumer Protection Law, or mandatory consumer rights in your own country where they apply. If a work arrives damaged, materially not as described, or is not delivered, contact us within 14 days of delivery, or of the expected delivery date, with photographs where relevant. We will arrange repair, replacement, or a refund as appropriate. Return shipping for a valid claim is arranged and paid by the studio. A returned work must be sent back in its original packing and condition.

Cancellation and returns — prints (Shop orders)

Prints bought through the Shop are produced to order, once a week: orders placed during the weekly order window are combined into a single production batch that is sent to the print house once the window closes. Your right to cancel depends on whether your order has entered that batch yet.

Before the order window closes (free, any reason): you may cancel your print order at any time between placing it and the order window closing, for any reason, for a full refund with no fee. Use the cancellation request link, WhatsApp, phone, or email above, stating your name and order details. We confirm cancellations in writing and refund within 14 days of your request, to the payment method you used.

After the order window closes: your print has entered that week's production batch and is being made specially for your order — a specific size and finish, produced to fill your order and not held as ready-made stock. Goods manufactured specially for a consumer following their order, under regulation 6(a)(2) of the Consumer Protection (Cancellation of a Transaction) Regulations, 5771-2010, are not subject to the standard cancellation right, and orders already in production generally cannot be cancelled for a change of mind.

This is never affected by the above: if a print arrives defective, damaged, materially different from what you ordered, or is not delivered, you are entitled to a full refund or a replacement, at no cost to you, regardless of when you contact us. This is a separate right under the Consumer Protection Law that no policy can limit.

This section describes our understanding of the mandatory provisions of the Israeli Consumer Protection Law. Wherever anything on this page conflicts with that law, the law controls and your statutory rights are not affected. If your personal circumstances (for example a recognised disability, senior-citizen status, or new-immigrant status) may entitle you to different rights under that law, tell us when you contact us and we will look into it.

Limitation of liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything that cannot be limited by law. Subject to that, the studio's total liability arising from a sale is limited to the price paid for the work, and the studio is not liable for indirect or consequential loss, or for loss of profit, opportunity, or expected appreciation in value.

Events outside our control

The studio is not responsible for delay or failure to perform caused by events beyond its reasonable control, including postal and carrier disruption, strikes, and acts of government.

Governing law

These terms and any sale are governed by the laws of the State of Israel. The competent courts of Tel Aviv-Yafo have exclusive jurisdiction, except that where you are a consumer with mandatory rights to bring proceedings in your own country of residence, those rights are not affected.

Live Salon and Auction Terms

These apply in addition to the Terms of Sale whenever you take part in a live auction.

Entry

The Live Salon is by invitation only. Entry requires a passcode shared with you by the studio. The passcode is personal to you and must not be shared. You must register with your real name and a working email address. The studio always sees your name and contact details. Other bidders see only what you choose: your first name and last initial, or an anonymous paddle number.

Bidding

• A bid is a binding and irrevocable commitment to buy at that price if it is the winning bid. Do not bid unless you intend to pay.
• Bid increments are set by the room. You bid at the next step, or you may enter a higher amount where the room allows it.
• If a bid is placed in the final two minutes, the closing time extends by two minutes so that everyone has a fair chance to respond. This can repeat.
• The studio may refuse or withdraw a bid, remove a bidder, or withdraw a work from sale at any time before the work closes.

Winning and payment

The highest bid at the close wins, subject to acceptance by the artist. The studio will contact the winner by email or WhatsApp with an invoice. Payment is due in full within five business days of that invoice, by the method stated on it. If payment is not received in time, the sale may be cancelled, the work may be re-offered or sold to the next bidder, and the studio may decline to accept future bids from you.

There is no buyer's premium unless it is clearly stated before the sale. Shipping, insurance, and any taxes or customs charges are handled as set out in the Terms of Sale.

Anonymity

Choosing to bid anonymously only affects what other participants in the room can see. It does not make you anonymous to the studio, which needs your identity to complete a sale and to meet its legal obligations.

Technical issues

If there is a genuine dispute about the state of the room, for example a connection failure at the moment a work closes, the studio will decide the outcome acting reasonably and in good faith, and may re-open bidding for a short period.

Accessibility Statement

Our commitment to making this site usable for everyone.

We want danielakrol.com to be usable by as many people as possible, and we aim to meet the Web Content Accessibility Guidelines (WCAG) 2.1 at level AA as a target.

Current status

The site is partially conformant with WCAG 2.1 AA. Most of the site can be used with a keyboard and with a screen reader: headings are structured, artworks have text descriptions, focus is visible, and colour contrast has been reviewed.

Known limitations

• The draggable channel carousel on the home page is designed for a pointer and is harder to operate by keyboard alone. Previous and next buttons are provided as an alternative, and every work in it can also be reached through the Collect view.
• The site uses some motion and transitions. We reduce these where your device asks for reduced motion, but coverage is not yet complete.
• Certificates of Authenticity and invoices are issued as separate documents and are not part of the site.
